Another ruling by the judge against the ACC...

The judge has ruled against the ACC on "ripeness" (i.e., the rediness of a case for litigation). The ACC argued that the FSU case should be contingent on more specific motions that were not part of their complaint or revised complaint. The judge ruled against the ACC motion.

Unlike arbitration, mediation is non-binding and a step the court often mandates prior to a trial. In this case, FSU and the ACC have already had some settlement discussions so I think that definitely contributed to this decision. If the case doesn't settle, they'll move forward with discovery. At the end of the day, I do think the parties will reach a negotiated settlement. After the error by the ACC today (admitting that ESPN has no rights to FSU games once they leave the conference), this may prompt the ACC to enhance those efforts.

ESPN may have no rights to FSU after they leave, but FSU can't leave without stroking a check for hundreds of millions of dollars. Given that, why would the ACC negotiate a settlement?

The buyout will be significantly lower than stated in the contract. The ACC cannot force anyone to stay in the floundering conference. At the same time, the current buyout is not going to hold up.

A reasonable buyout it coming. The ACC has dealt all their cards, and it’s not a good hand. Goodbye ACC. Wish you could have managed the business more lucratively, but the league has overestimated their value and ESPN is telling them they won’t renegotiate a TV contract with the current state of affairs. The ACC has no bargaining power, and the “contract” is falling apart.

What does that mean "the league has overestimated its value". The "value" is what ESPN pays them per the GOR.

And why would the ACC agreed to a "reasonable" reduce exit fee which would kill the conference? They may be dumb but they aren't stupid. It doesn't even make sense.

Because the Fl. Judge is going to rule that the fee to leave is a penalty and is excessive. He stated today that just because someone entered a contract, when that contract had unreasonable penalties or punishment in it, it could be voided.

He basically told the ACC, the cost to leave is an exorbitant penalty and courts have voided those contracts. I am sure he has plenty of case law to support that.

He told both sides that they both knew what was at issue in the dispute and it should not be hard to reach a settlement agreeable to both sides. He wants this settled so that FSU can leave before Aug. 15 but can play the 2024 ACC schedule.
He is not going to rule in ACC favor of having a 500 million dollar ransome to set FSU free.
The ACC and ESPN know this.

The ACC is going to have put a value on the TV Rights through 2036 and provide how they determined that value. IMO, that's going to show how inflated the ACC"s numbers are right now. On the other hand, if the numbers are truly as high as the ACC says, I'm sure Clemson and FSU will have no problem staying in the ACC if they are getting $75 to $80 million each per year.
