Can scholarships be written to enforce term limits or paybacks?

For example can a scholarship have a clause that states you must pay back the tuition/aide that was granted if you do not graduate.
There has to be a way to put the student back into student athletics. If kids want to play college sports for money then they have no business getting my tax dollars that fund academic athletic scholarships.

Doesn't the athletic department pay for those scholarships? I don't think much of that money (if any at all) comes from tax dollars.
If a school wants to try to punish their athletes for signing NIL deals ("play[ing] college sports for money") they should be prepared to lose out on every decent recruit that has other options.

You were able to claim 80% of the donation for personal seat rights like season tickets for college sports events as a tax deduction before tax reform, you can no longer claim any of the donations as a tax deduction.
2019's Tax Cuts and Jobs Act (“TCJA”) eliminated that 80% rule and removed deductions for these donations, see Internal Revenue Code Section 170(l). The language in Section 170(l) is quite clear:
"No deduction shall be allowed for any amount paid to or for the benefit of an institution of higher education if the payer receives (directly or indirectly) as a result of that payment the right to purchase tickets to an athletic event at an athletic stadium at that institution.

I'm not sure what bucket it comes from...even still...I think a player should sign a contract with a school that includes a transfer buyout for any funds the school may have granted the player during their time enrolled.
And how is that punishing them?

Schools/athletic programs. Contracts would require the athletes to be treated as employees, and that will open up a whole other can of worms in the form of employment law.
I'm not a fan of where we are now, and I'm fine with biting the bullet and crossing that threshold, but at that moment every pretense of amateur athletics will be gone, and schools/athletic programs will be on the hook for much more once student athletes are afforded the protections of employment.
One could argue it's the right (and frankly, honest) thing to do, but it will have MAJOR impact on athletic programs across the country.

1. need graduation % directly linked to maximum allowed players. Not scholarships, total player count. 98% graduation rate, you get 98% of allowable players. Its about time to be serious about academics and less about NFL-lite.
2. Sit a year if you portal before graduation or lose a year of eligibility.
NO contracts with players.....definitely don't want unions involved in college. ugh.

The schools are already getting more than their money's worth by funding those scholarships. They have more revenue than they know what to do with. The administrators and coaches make outrageous amounts of money, not to mention the buyouts when they get fired. Some schools have nicer athletic facilities than some professional teams. They make so much money from football that they can afford to bankroll a bunch of other sports with it.
If the athlete has to pay back any financial aid received while enrolled at the school, then to be fair the school should also vacate any wins that player played in.

Sorry but in no way does that compute. What’s UNFAIR is a school investing $100’sK in an athlete (education, physical & athletic development, healthcare, nutrition, etc) & getting little to nothing back in return

It's indentured servitude. It's also a breach of contract in the part of the school. Scholarships are year by year. Once a player finishes a semester, he's fulfilled his school requirements. Requiring him to pay it back at that point would be extortion.

Any Div 1 schools that tries this on recruits until ALL players are required to be under contract and a pay scale is setup like the NFL, won't be able to compete in Div 3.
