Isn't the Clemson Tiger Paw Trademarked?
Jun 22, 2015, 11:23 AM
|
|
Reason I ask something that I know the answer to is because I've been living in the state of Alabama for the past 18mths and the other day this guy asked me what year did i graduate from Chilton county High School. I told him i was from SC and that the paw was for Clemson University. So I did some digging and I found out Chilton County High School is in Clanton, AL and is using the tiger paw image on their website.
http://chiltoncountyhigh.al.cch.schoolinsites.com/?PageName=LatestNews&Section=Highlights&ItemID=198987&ISrc=School&Itype=Highlights&SchoolID=6371
Should we report it to the powers that be at Clemson [if so who?] or i'm i being petty for wondering if they are using proper licensing?

I'm half tempted to buy a couple of their shirts. They're cheaper than ours.

I wouldn't say it's petty. You could report it. I would assume the webmaster there just isn't too bright and doesn't realize what he did was wrong. I'd contact that site and mention it to them first. I'm sure they would change it.

probably a harmless (I hope) mistake, give them a chance to change it themselves first and if they don't within a reasonable amount of time, then report it

I work in a school system, and every person employed by our school system from custodial staff to superintendents had to attend a workshop on copyright infringements and sign off on it. They should know better.

This in infringement in my view as I think CU Paw is

a unique rendition that is protected. Thus they need to at least change their paws design and angle that it is . I believe I am correct.
The Tiger Paw logo was introduced at a press conference on July 21, 1970. It was created by John Antonio and developed by Helen Weaver of Henderson Advertising in Greenville, South Carolina, from a mold of a Bengal Tiger sent to the agency by the Field Museum of Natural History in Chicago.[1][2] The telltale hook at the bottom of the paw is a sign that this is the official licensed trademark for the university.[3]
"If you've ever wondered why the Clemson Tiger Paw has a small fishhook-shaped indention on the base, well, that's a scar from a wound the tiger — whose paw was used to make the cast — had received."[4]

Probably should have someone from

Clemson University contact the school and just inform them that they are using a copyrighted image for their logo...
It's obvious that they copied the exact logo, the scar on the paw print is visible on all of the images.
After being contacted by the University, I'm sure there is a protocol in place for what happens next; cease and desist letters, etc.

Judging from the bad photoshopping of the apparel

I'd say we are probably getting paid for that use anyway. It looks like they've just taken Clemson apparel and either left it alone if it didn't say Clemson or added Chilton/Clanton if it did. I swear I've seen that gray dri fit jacket at Tiger Sports Shop.

We have a contract with Nike, no way they would undercut themselves by selling trademarked apparel as someone else's stuff when they have a contract with Clemson. Looks like Clemson might actually be profiting due to the flattery.
Although there is no harm in reporting to Clemson to make sure they know and it's on the up and up.

There's a few teams in Tennessee who use the Paw.
Jun 22, 2015, 11:53 AM

I met some of their fans. At least one public school in East TN uses the paw along with a few private schools and several dixie-type league teams. While being quizzed by several of their fans I denied knowing about their school or team they would immediately ask about Clemson. Their coaches past or present initiated the use of our Paw.
I just can't imagine what else we could want. Folks learn about Clemson from their own traditions, coaches and become endeared to our culture by we grads and fans being cordial with them.
I guess it will all come down to money. Until the manufactures of Paw gear stop paying for the use of our Paw then we should let things be, take the money, publicity and possible fans.

Yes, bit I believe they have to request and receive permission on a case by case basis.

It isn't a big deal. That's why colleges let the high schools use their logos.

CLEMSONLICENSING-L@LISTS.CLEMSON.EDU
I had an issue with an Orange Bowl helmet last year (stripes were reversed). CU requested a picture of the helmet, which I sent in. Not sure if they ever got it resolved, but it's worth a shot.

the use of the paw can be purchased by schools, organizations, etc. It is very expensive to do. Tim Match is in charge of that area - someone can send it to him.

I would report it ASAP. If this a generic paw print I wouldn't care-but this as the rough edges and the scar in the pad.
