Need some advice...

I made a huge mistake. I purchased 4 tickets to the Carolina game from a guy posting on craigslist. He also has posted in Tiger Tickets. Anyway, they were electronic tickets. I bought them for friends and family to go to the game with me, and they backed out. Once they backed out I was going to sell them, so I wanted to call the Clemson ticket office to verify the barcode numbers. They were all "not in the system". I immediately contacted the seller and he swears they are real and will scan. I do not want to sell them, and sell someone fake tickets. Once i told him I called the ticket office to verify, he said he contacted stubhub(where he bought them from) and that they were going to send new tickets once they verified these were fake. I called stubhub to check his tracks, and stubhub has no record of him buying them. I paid through paypal and have now filed a dispute. I requested a refund, and he has not responded to it, nor my text. Should I escalate to a claim, and let paypal decide? Lesson learned, I know that.

Don't see that you have any other option other than eating the loss. He clearly isn't being up front about it. Frankly I'm surprised you were able to track it down this far in advance when you can still do something about it.

they are pretty good and you are protected against fraud...I've had an incident in the past and PayPal bailed me out.

I filed a claim and immediately paypal closed it saying that their complaint policy only deals with the shipping of items and not the quality of the items. But it had an option to select " not as described" and "fake imitation" which I selected.

If you’ve purchased your item through a PayPal-verified seller, you’re covered for your original purchase price plus shipping. This protection covers you only for nondelivery of tangible items and tangible items that are received significantly not as described

Exactly. I figured "significantly not as described" fitted well with tickets that were fake. Apparently not.

If contesting it with the credit card company isn't an option for you, call paypal and tell them you never received the tickets and if they ask say you mistakenly clicked the wrong thing when you filed. It's true, you never received tickets to the game. I seriously doubt they will deny you your right in this case. Most companies are reasonable when you talk to them by phone.

you use to fund paypal. I've heard paypal is no good dealing with disputes. Both times I've had problems, I contested it with AMEX and it trickled down through paypal to the seller pretty fast. Just two weeks ago I had to do this. Just handle it calmly and politely and they'll do the rest. Visa and Mastercard are harder to deal with, but it's been years since I've had to deal with them. I'll bet they are better nowadays.
