If they were to finish in the top 16 in the BCS, then yes

they would have absolutely kept us out of the Sugar Bowl. We could have been 11-1 and ranked right behind Oregon and Florida (other non ND at large berths) and had to go to the Bowl formerly known as Peach. The rule is that any team finishing in the top 16 of the final BCS standings that does not belong to an AQ conference gets the first at large berth. If Boise State, NIU, and let's just say San Jose State has all ended up in the top 16, they would have bumped Oregon, Florida, and the other at large pick for the Sugar Bowl, likely Oklahoma, but still a slim change for our Tigers.

The rule, I believe, only applies to the highest BCS ranked team from a non-AQ conference. Also the automatic birth for NIU (if they get one) will be because they are in the top 16 AND ranked ahead of a conference champion from one of the AQ conferences.
