The article even states that it is unusual to dismiss at this stage, so no surprises. Also zero surprise that a North Carolina court sided with the ACC. The more interesting aspect will occur next Tuesday.

If FSU ran a tight ship instead of acting like a petulant teenager of TikTok, they could have most likely locked down venue in FL. Conversely, the ACC was caught flat footed when we filed in SC even with a draft Complaint presumably sitting on their lawyer’s desk in Charlotte. That being said, plenty of runway to unfold in NC case. IMO, neither institution should let our f#$&face of a commissioner step foot on our campuses. I wonder when dufus will get deposed or hit the witness stand for his failures at Northwestern?

I’ve wondered the same thing about the Northwestern case(s). I haven’t followed lately. I’m guessing they are settling everything to keep a lid on it? I recall the program was accused of “ritual abuse” by many athletes for all the hazing and sexual abuse that allegedly happened across multiple men’s and women’s sports.

The hearing in Tallahassee next week is an argument over that. ACC is arguing the suit filed in FL should be dismissed.

Both schools signed it not once but twice. I would love Clemson out of the ACC, but legally they signed it and now have buyers remorse. Those involved with signing this should be fired if they are still around?? We are gonna have to pay a ton to leave. Not all of it but a ton.

People sign contracts every day for multi year deals then realize they are getting shafted and want out. Guess what happens? 90% of the time if you have an attorney worth a crap and money to spend, these disputes come down to a settlement just like this will

want the negativity and ill will or bad press that would ensue from a highly disgruntled member that wants to exit?
Best thing for all parties is to get out of the courts and settle immediately. Let Clemson, FSU and any others wanting out to settle and leave. Then, the ACC can go add whomever they choose...UConn, UMass, Navy, etc., etc., etc.

The ACC as a conference does not want out of the contract with ESPN as it pays above market value. There is no where else to go who will pay more money. The 2-3 top teams want out as there individual brands are worth more but the bottom dwellers not so much.

Well, there goes the argument that the ACC has not done its duty to get the best deal for its members. If the ACC's current TV contract is worth more than the true market value of the conference, then the argument that the ACC has not properly represented its members will not work.

The deal was good at the time it was signed. It is still good for all but a few teams. People who sign contracts don’t have a crystal ball to see the future so firing someone for because things took an unexpected turn seems silly at best.

Kinda depends on what you are looking for? We are the ACC, original founding member...FSWTC is a late Comer with a bad pedigree, hope you don't want Clemson to emulate them! Not quite sure what CCC and some of the TNET members have morphed into! I just hope Clemson does not get out of this fiasco exactly what we deserve!

I'm still not sure how they managed to do that. I think they told everyone they were going to file a lawsuit and then their board of governors took a day to approve it. How do they not have their ducks in a row?

...this is my understanding of the timeline.
State of Florida has very strict government in the sunshine laws. BOT meetings must be announced 48 hours in advance and an agenda must be published. Discussion on any issues requiring a vote must be held during that meeting. So, ACC had at least a 48 hour notice that FSU would probably vote to sue the ACC.
ACC put together a suit and filed it the day before the FSU BOT meeting. ACC broke their bylaws by filing the suit before having a vote by the university presidents. Abut 3 weeks later, they called a meeting and got the necessary votes to "retroactively approve" filing the suit.
This situation is far more complex than folks on the internet are trying to make it out to be. There are currently 4 suits on going. ACC sued FSU in NC. FSU sued ACC in FL. Clemson sued ACC in SC. xACC sued Clemson in NC. (And, speculation is there will be UNC sues ACC and ACC sues UNC soon added to the list.)
It is not a slam dunk victory for anybody. Virtually all attorneys who seem to be reasonably educated on this type of case say that the cases will continue for a while but at some point both sides will come to a monetary agreement outside of court and none of the cased will ever go to trial.
